Minister Barroso defined suspension for six months in 2021 and, in December, extended the deadline until March. In the new decision, the minister appeals to Congress to create a 'transition', avoiding a humanitarian crisis.
The Minister of the Federal Supreme Court (STF) Luís Roberto Barroso decided, monocratically, to extend, until June 30, the suspension of evictions and repossessions.
In June 2021, the minister suspended, for six months, evictions or repossessions in areas already occupied before the Covid pandemic. In December, Barroso extended the effects of the decision until March this year.
First, I note that the grounds that justified the granting of the first precautionary measure granted on 06.03.2021 are still present. The Covid-19 pandemic is not over yet and vulnerable populations are at particular risk.
"It is therefore necessary to establish a transitional regime, in order to avoid that the realization of repossessions throughout the country at the same time leads to a situation of humanitarian crisis", said the minister.
There are, however, cases in which eviction is still authorized. Therefore, it is necessary to analyze each situation individually with expertise.
